Government has 10 days to defend Armm poll delay

THE Supreme Court (SC) has given the government 10 days to respond to petitions seeking to block the postponement of elections in the Autonomous Region in Muslim Mindanao (Armm).
At a press conference Tuesday, SC spokesman Jose Midas Marquez said it will not yet issue a restraining order against the implementation of Republic Act (RA) 10513, which moves elections in Armm from August this year to 2013.
He said respondents Executive Secretary Paquito Ochoa Jr., Budget Secretary Florencio Abad, National Treasurer Roberto Tan, and Commission on Elections chairman Sixto Brillantes Jr. will be given a chance to give their comments before the court decides.
House Minority Leader Edcel Lagman, lawyer Romeo Macalintal, and minority party Partido Demokratiko Pilipino-Lakas ng Bayan (PDP-Laban) have filed separate petitions against the law.
The petitions have been consolidated, Marquez said.
Lagman said the law violates “constitutional and statutory safeguards for autonomy in Armm.”
PDP-Laban, meanwhile, said the law violates the autonomy of Armm and the party’s right to field candidates in the elections.
The petitioners have asked the SC to issue injunctions to prevent the government from implementing RA 10153 until the High Court rules on whether it violates the 1987 Constitution.
On Monday, Comelec spokesman James Jimenez said the poll body may ask for an extra month to prepare for elections if the SC strikes down RA 10153.
“You have to understand, it’s a bit late now since it’s now July and the elections are scheduled for next month. Even if they (SC) act today, that will still leave us a little over a month to prepare. That will be a bit difficult,” Jimenez said. (Jonathan de Santos/Sunnex)
