Proposed law requires businesses to identify, quantify emissions

PHILIPPINE companies may soon have to register not just their business names and addresses with the government but also how much pollution they emit.
Senator Miriam Defensor-Santiago has filed a bill that will require the Environmental Management Bureau to maintain a list of “all forms of pollutants, hazardous and toxic chemicals, and all forms of emissions and discharges” that come from local facilities and industries.
This list will be called the Philippine Pollutant Release and Transfer Registry (PPRTR).
The bill will require businesses to disclose the kinds and amount of pollutants that come from their facilities or face a fine of P50,000 to P1 million.
The database will be under the administration of a PPRTR Office that will also conduct research on pollution control, prevention, and mitigation as well as green chemistry and clean production.
The database is meant to give the general public information that will identify and assess possible threats to the environment from businesses.
“This will prevent pollution and the release or pollutants from various sectors by encouraging the implementation of cleaner technologies and to help the private sector to comply with environmental rules and regulations,” she said.
The pollutant registry will also help the government check the implementation of the Clean Air Act, Clean Water Act, Ecological Solid Waste Management Act, and other environmental laws, she said.
Santiago has also filed a bill to create a trust fund that the Department of Environment and Natural Resources will use to give barangays cash grants for projects to help them comply with environmental laws.
In the explanatory note of her bill, Santiago said the implementation of those laws is often ignored and “always take the backseat to our continuous struggle to fight corruptionand alleviate poverty.” These laws are often left unimplemented because local government units have little money left, she said.
“There needs to be a bill that will provide for an alternative and complementary source of funding for compliance to environmental law to ensure that even though such efforts are given a small share in local government funding, the barangays will be empowered to be in the forefront of protecting the environment,” she said.
If passed into law, DENR will pool money collected from penalties for failure to comply with environmental laws into an Environmental Compliance Trust Fund. That money will then be used for barangay “projects and activities to assist communities in complying with environmental requirements under laws administered by the DENR.”(Jonathan de Santos/Sunnex)
