GMA arraigned

Manila, Philippines – Former President now Pampanga Rep. Gloria M. Arroyo was arraigned yesterday at the Sandiganbayan.
However, because she does not yet recognize the jurisdiction of the Sandiganbayan, Arroyo refused to enter any plea in connection with the plunder case filed against her by the Ombudsman for allegedly diverting P366 million in intelligence funds of the Philippine Charity Sweesptakes Office (PCSO) during her term as Chief Executive.

Because of this, the Sandiganbayan entered a not guilty plea on her behalf.
Despite her weak health condition, Mrs. Arroyo was brought under heavy police security to the Sandiganbayan from the Veterans Memorial Medical Center (VMMC) both in Quezon City where she is currently under hospitalarrest.
Accompanied by her husband, former First Gentleman Jose Miguel T. Arroyo, her three children Luli, Camarines Sur Rep. Diosdado M. Arroyo, and Ang Galing Pinoy party-list Rep. Juan Miguel M. Arroyo, and lawyers, Mrs. Arroyo arrived at 7:30 a.m., one hour before her arraignment at the First Division of the Sandiganbayan.
She was on a wheelchair, had a neck brace, and a pink shawl. She looked calm and composed as she seated in front row of the court room.
Commenting on the legal strategy of the Arroyo camp, Atty. Raul Lambino, political and legal spokesman of Mrs. Arroyo, said it is the right of any accused, including Mrs. Arroyo, not to enter any plea because it is stated in the law.
“It is her right not to enter any plea and it is the right of anyone to do that. Karapatan ng isang akusado iyan ang mag-enter ng plea at pwede siyang hindi mag- enter ng plea, at nasa batas yan,” Lambino said.
He defended the legal move of the Arroyo camp, insisting that it has a pending pending petition before the Supreme Court (SC) questioning the jurisdiction of the Ombudsman and the Sandiganbayan First Division.
Lambino reiterated there was abuse of discretion on the part of Ombudsman in filing the plunder case against Mrs. Arroyo as there was already an earlier finding of a five- man investigation panel of the Ombudsman that found no probable cause to file the charge.
TRO ISSUED
The SC stopped the Sandiganbayan yesterday from implementing the warrant of arrest it issued against Arroyo and her co-accused in the case.
“The court issues a TRO, as prayed for, enjoining the Sandiganbayan from implementing its assailed resolution dated Oct. 3, 2012 which directed the issuance of warrant of arrest against petitioner, among others,” the SC Third Division said in a two-page resolution.
SC acting Public Information Office chief and spokesperson Atty. Maria Victoria Gleoresty Guerra said the SC issued a TRO against the implementation of the October 3, 2012 resolution issued by the Sandiganbayan finding probable cause against Arroyo, former PCSO General Manager Rosario Uriarte, former PCSO Chairman Sergio Valencia, former PCSO Directors Manuel Morato, Raymundo Roquero, Jose Taruc V, and Maria Fatima Valdes, former Commission on Audit (CoA) Chairman Reynaldo Villar and CoA Region 5 (Bicol) head Nilda Plaras, and PCSO Assistant General Manager for Finance Benigno Aguas for plunder.
Arroyo and Plaras filed separate petitions before the SC seeking to stop the Sandiganbayan from implementing the resolution.
Meanwhile, Malacanang said it respects the decision of the SC to issue a TRO in favor of Arroyo and her co-accused.
“That is a decision coming from the Supreme Court and as always, we respect the jurisdiction of the Supreme Court,” presidential spokesperson Edwin F. Lacierda said.
The Palace official said that what is important is that the plunder case against the former President is already moving. “Ang mangyayari lang, hindi muna itutuloy ang kaso because of the TRO. Also, the venue will be transferred from Sandiganbayan to the Supreme Court for the meantime until the SC decides on the petition filed by the camp of the former President,” Lacierda said.
“At least, ang importante, na-arraign na siya, pwede nang tumakbo yung kaso (At least what is important is that she has been arraigned and the case can now move forward),” he said. “At the very least, the former President has already been arraigned and the court has acquired jurisdiction over the person,” Lacierda said.
