IN MY previous article, we talked about protecting your green card by residing permanently in the US and what steps should be taken in unavoidable situations where you may be outside the US for a specific period of time.
There are other ways in which you would be able to protect, preserve and maintain your green card. Some are common sense while others may require a degree of professional help.
1. Do not commit a crime. This falls under the common sense category. Even though you are not a US citizen, you are expected to obey state and federal laws. Your criminal case presents a legal headache for your immigration status. Generally, crimes classified as aggravated felonies, drug offenses, domestic violence offenses, firearms offenses and crimes involving moral turpitude would subject you to deportation proceedings. This list is not exclusive. There are other crimes that can affect your immigration status. If you find yourself accused in any criminal case, it is advisable that aside from hiring a defense attorney, you would also have to retain an immigration attorney to properly advice you and your criminal lawyer of the immigration consequences of your case.
2. File a US resident tax return. Lawful permanent residents are considered residents of the US for income tax purposes, thus your income regardless where it was earned, should be declared in your US tax return. As is most common to most green card holders who are still Filipino citizens, you may have a business located in the Philippines, (an apartment or a farm or a convenient store), the income derived from that business should be declared in your US tax return. As this involves application of complicated tax laws of different countries, you may want to consult an accountant with expertise on matters like these. Of course, it goes without saying that your obligation to file a US resident tax return is not satisfied by just mere filing, you should also file an honest and truthful tax return. You do not want to be chased by the IRS for tax evasion.
3. Remember, you are a permanent resident. Do not claim that you are a US citizen. I have heard cases where people claim that they are US citizens even though they are not just to access benefits reserved for US citizens. And because you are not a US citizen, you cannot vote in any election. I had a client who contacted me because of his dilemma. He is afraid to file to file his citizenship because he voted in the 2008 presidential election while a permanent resident. This is a deportable offense.
4. Notify the USCIS within 10 days of changing your address. This is very easy as you can do this online. But do not be deceived. Even though this sounds so simple, a lot of people fail to do this without realizing that this is a deportable omission.
5. Register for Selective Service if you are a male, aged 19-25. Selective Service is a federal agency tasked to provide trained and untrained personnel to the US Department of Defense in the event of a national emergency. You can register online or in person.
Maintaining and preserving your lawful permanent status should be your main priority. Remember the hardships you and your family went through just to acquire it. With just a little patience, it is your gateway to becoming a naturalized US citizen.
