Keep 6 items taken from Bella’s house: pa to court

RENANTE Pique, the father of Ellah Joy, has filed a motion for partial reconsideration, asking Judge Meinrado Paredes to retain six items seized from the house of suspect Bella Ruby Santos.
These are the Mitsubi-shi Pajero, hair strands, a local area network (LAN) cord, porno CD, two stones and the waiver.
“The hair strands may be that of Ellah Joy, while the LAN cord and the stones are similar to that found with the body of the little girl. The stones are believed to be intended as a sinker to hide the body, which fortunately did not reach the waters down the cliff,” Pique’s motion read.
As for the Pajero, police suspect it may have been used to dump Ella Joy’s body by the roadside near Sayaw Beach in Barili last Feb. 9
Contraband
Renante’s lawyers Joan Saniel-Amit, Noemi Truya-Abarientos and Jo-Ann Suarez-Pabriaga of the Children’s Legal Bureau also said some of the seized items, including the pornographic compact disc covers, are contraband under Republic Act (RA) 9775, or the Anti-Child Pornography Law.
They said child pornography refers to “any representation, whether visual, audio or written combination, thereof, by electronic, mechanical, digital, optical, magnetic of any other means, of child engaged or involved in real or simulated explicit sexual activities.”
Paredes, presiding judge of the Regional Trial Court Branch 13, gave the defense five days to comment on the motion.
CIDG’s motion
The judge earlier ordered the return to Santos of the Pajero, hair strands, LAN cord, Nintendo game cartridge, a rug, sex toys, empty porn compact disc covers and assorted CDs, waiver, IDs and passport and two stones.
The Criminal Investigation and Detection Group (CIDG) 7, however, immediately filed a motion for partial reconsideration, asking Paredes to revisit his order returning the Pajero to Santos.
That motion is set for resolution by the court.
Inocencio dela Cerna and Glenn Condor, counsels for CIDG 7, also filed last Monday a motion, asking the judge to allow them to conduct forensic examination on some items seized from Santos’s house.
Police said the conduct of forensic exam on April 25 is necessary to “ensure the integrity” of the evidence.
The items the police want examined are the bed sheet with suspected bloodstains, blanket with suspected bloodstains and a portion of the bed and mattresses with suspected bloodstains.
A kidnapping with homicide charge was filed against Santos and her British boyfriend Ian Charles Griffiths at the Provincial Prosecutor’s Office.
