Arroyo unaware of travel restraint circular

FORMER President Gloria Macapagal-Arroyo should not be blamed for a controversial circular restricting foreign travel of Filipinos that was implemented under her watch, one of her husband’s lawyers said.
This developed as lawyer Ferdinand Topacio, counsel for Arroyo’s husband Jose Miguel, repeatedly assailed the legality of the Department of Justice Circular 41 in an oral argument on the issue before the Supreme Court.
The circular, issued a month before Arroyo stepped down as president in June 2010, was used against the former presidential couple from travelling abroad since they were subjects of a poll fraud investigation.
“I do not think she knows about this because this circular does not bear her signature. It’s highly possible that some acts of a Cabinet secretary are not known to the President. Now, if your secretary did something wrong, it doesn’t mean that as President, you are liable unless you directed him to do so,” Topacio told reporters.
Arroyo has since been placed under police custody at the St. Luke’s Medical Center in Taguig City after she was indicted for sabotaging the election results in 2007.
The former President is currently suffering from bone mineral disorder and hypoparathyroidism.
On Thursday, Topacio reiterated his opposition to the circular as he asked the justices to “do something about it.”
“It was wrong then, it is wrong now. And it could still be wrong in the future, unless corrected,” he said, adding executive acts should be backed up by law.
Arroyo said the directive should be stricken down for violation of the constitutional right to travel.
Sun.Star has sought comment of Alberto Agra, Arroyo’s former Justice secretary who reportedly consolidated all orders in DOJ Circular 41, but he has yet to issue a reply as of this posting.
Asked for comment, the National Union of People’s Lawyers (NUPL) expressed disbelief over Topacio’s statements.
“That’s incredible. He is stretching the limits of credulity. She (Arroyo) and her security cluster used it several times to harass and persecute political dissenters and critics. Her Justice secretary’s acts are hers too unless she disowns it, which she did not,” NUPL secretary general Edre Olalia told Sun.Star.
Based on data gathered by Associate Justice Lourdes Sereno, the past administration issued around 6,000 watchlist and hold departure orders during its nine-year rule.
But if he could only turn back the time, Topacio said he is confident that the High Court will declare the circular as unconstitutional.
“It’s an indefensible position,” he said.
