Court’s decision on 2007 polls ‘moral victory’

CITY OF SAN FERNANDO – “It’s simply a moral victory.”
This was Governor Lilia Pineda’s reaction with the recent Supreme Court’s decision junking the appeal of former governor Eddie Panlilio which questioned the Commission on Elections (Comelec) ruling declaring Pineda as the duly-elected chief executive of Pampanga in the May 2007 elections.
Panlilio’s petition was rendered moot and academic by the High Court following the regular national and local elections in May 2010, and the proclamation of winners.
This, the ruling said, “has left the Court no alternative except to dismiss the petition in accord with jurisprudence to the effect that the expiration of the contested term of office renders the petition moot and academic.”
Pineda won the gubernatorial race of May 10, 2010 and assumed office on July 1, 2010.
As per Comelec records, Panlilio won in the 2007 polls with 219,706 votes, as opposed to Pineda’s 218,559 votes.
Pineda contested her win before the Comelec and after a revision of votes, the Second Division subsequently declared her as the duly elected governor.
The Comelec declared that Pineda’s votes totaled 190,729 votes as against the 188,718 votes cast in favor of Panlilio.
Panlilio was then ordered by the Comelec to vacate his post but continuously performed the duties of a governor while the case is still pending before the Supreme Court until his term ended.
“I was not proclaimed and I did not sit as governor,” Pineda said.
It can be recalled that Panlilio served his full term as governor from July 30, 2007 up to June 30, 2010. Pineda did not sit even a single day at the Capitol during that period.
Panlilio elevated the case to the Supreme Court on May 17, 2010.
