Courts urged to summon Arroyo doctors
MANILA — The government asked the Supreme Court on Wednesday to summon the doctors of former President Gloria Macapagal-Arroyo to settle doubts on her medical condition.
In a four-page motion, the Office of Solicitor General said the doctors should confirm if Arroyo’s condition is life-threatening and requires her to seek medical treatment abroad.
Arroyo has been diagnosed with hypoparathyroidism and bone mineral disorder.
The High Court will hold another round of oral arguments on Thursday to determine the constitutionality of the Department of Justice Circular 41, which was used to bar Arroyo and her husband Jose Miguel from leaving the country.
If the Court sides with the government’s motion, the following are set to appear at the public debate: Dr. Mario Ver, active consultant at the Institute of Orthopedic and Sports Medicine, St. Luke’s Medical Center in Taguig City; Dr. Juliet Gopez-Cervantes, Arroyo’s attending physician; and Dr. Roberto Mirasol, also from St. Luke’s.
Justice Secretary Leila de Lima turned down Arroyo’s request for overseas travel early this month after discrepancies in the latter’s medical condition were cited as expounded in the submitted medical abstracts.
In her October 21 affidavit, Cervantes certified that Arroyo has metabolic bone disease but maintained that she “should fully recover from her spine surgery in six to eight months, barring any complications.”
Mirasol, meanwhile, stated in the October 22 abstract that “an underlying rare metabolic bone disease could not be totally ruled out and she may require a bone biopsy.”
Ver’s medical abstract prepared last October 24, however, failed to mention any metabolic bone disease at all.
Pasay court
The Commission on Elections (Comelec) also asked Wednesday the Pasay City Regional Trial Court (RTC) — the same court that placed the former President under arrest after being charged for electoral sabotage — to summon doctors Ver, Cervantes and Mirasol, compel them to testify, and submit Arroyo’s medical abstracts.
Comelec spokesperson James Jimenez said the poll body seeks to find out Arroyo’s medical condition “to determine whether hospital arrest is justified.”
“Gusto namin masiguro is kung dapat talaga siya sa hospital. Not the hospital arrest but whether her condition really requires her to stay in the hospital,” Jimenez said.
Earlier, Justice Lourdes Sereno said Arroyo could have lied about her true medical condition, a position she maintained during the oral arguments at the Supreme Court last Tuesday.
“Everyone has right to an improved quality of life. I will pity anyone who will wear halo vest and Minerva brace but the picture that you attached in your petition was taken in July, and doctors said she is now in a much improved condition,” she told Arroyo’s counsel Anacleto Diaz.
For his part, Ferdinand Topacio, who represents Arroyo’s husband, Jose Miguel, in various high-profile cases, said the former leader’s condition is “not the issue before the High Court.”
“The issue is purely legal — the right to travel as guaranteed by the Constitution,” he said in a text message to Sun.Star. “They are muddling the issue because they have run out of legal arguments.”
Senate panel
Whether Arroyo’s doctors will be summoned to appear before the Supreme Court and Pasay RTC, doctors Ver and Cervantes are expected to attend the next joint hearing of the Senate blue ribbon committee and committee on electoral reforms next week, Senator Teofisto Guingona III said Wednesday.
The Senate panel will also ask Arroyo’s doctors whether her mineral bone disease and hypoparathyroidism are life threatening and require “urgent” treatment abroad.
“The Philippine Medical Association, through (Dr. Leo) Olarte said the medical facilities and the doctors here are enough to treat GMA (Arroyo)’s condition. But (GMA’s camp) say there are no facilities or doctors here. We need to look into this,” Guingona said.
Olarte, PMA governor for Manila, has also said the bone biopsy that Arroyo’s spokesperson said she needed done can be performed in the Philippines even by doctors who are not specialists.
The senator admitted the doctors might invoke doctor-patient confidentiality to refuse answering questions but said “we’ll cross that bridge when we get there.”
For its part, Malacañang remained skeptical about the former President’s medical condition.
“For the past few weeks, we have not heard from the doctors the current medical status of the former President. All we have heard are statements coming from the various spokespersons. The best person to testify as to the true medical condition of the former President would be the doctors themselves,” Lacierda said.
Lacierda also believed the condition of Arroyo “is not life-threatening” based on the assessment of Health Secretary Enrique Ona, who visited the lawmaker during the height of Arroyo’s travel request issue.
Ona earlier said Arroyo, who underwent a series of surgeries on neck and spine, is recuperating well.
“Isn’t it obvious? We have questioned in the past why she will be traveling in six countries, she will go to America, if you are really in a life-threatening condition, will you attend Clinton Global Initiative? That’s not even medical-related and that’s the reason why we have turned down the request to travel abroad. That has never been an issue and they have changed it from six countries to three countries—in all those times they have never mentioned the specialists in their request,” Lacierda added.
