PB hopes Environment Code will be approved this year

A PUBLIC hearing on the proposed Cebu Environment Code raised some unclear areas in the environment laws that the code is meant to address.
The draft code includes provisions on watershed boundaries, land uses, as well as the ownership of reclamation projects pursued in Cebu by the National Government.
“Tambakan nila og anapog ang dagat, sila na dayon ang tag-iya? (The National Government dumps some limestone in the sea, then they automatically get to own the property?)” Provincial Board (PB) Member Thadeo Ouano pointed out after the hearing last Friday.
The code, he said, will serve as a guide and also address the “signs of times”, like global warming.
Vince Cinches, country coordinator of the environmentalist group 350.org, welcomed the code, but urged lawmakers to fine-tune some of its unclear provisions. His group will come up with a consolidated review and position two weeks after the consultation.
Ouano, who said he considers environmentalists as “our partners”, is hopeful the code will be passed before the year ends.
Cinches is among the environmentalists critical of Capitol’s encouragement of coal-powered plants and the use of its coal ash by-product.
He said the acceptable atmospheric concentration of carbon is 350 parts per million (ppm) and Cebu is already at the 392 level.
Cinches observed that Article 10 of the proposed code is biased against renewable energy sources. It states: “The Province recognizes the need for more efficient and renewable generation of power, although the cost of energy from most renewable sources is not competitive in the open market.”.
Coal-fired plants may be “cheaper” than other sources of power, but their cost escalates when one considers their effects on the people’s health, the ecosystem and climate change, said Cinches.
He commended the provision on allowing the people to decide which energy source they will use.
“The Province will support Cebuanos’ concern for the environment and the future generation by encouraging subscription to such source of energy on a voluntary basis,” the code stated, also in Article 10.
Former PB member Vic Maambong, who used to chair the environment committee and is now Ouano’s consultant, explained why it took the more than 10 technical working group members months to come up with the code’s draft provisions.
To avoid incompatible land uses, the code provides that the Province will manage and prepare a land use management plan, on its own initiative or upon recommendation of concerned local government units (LGUs), when the particular land area falls within the jurisdiction of three or more LGUs.
Some examples of these areas are watersheds, transport corridors, solid waste facilities, large power estates and forest reserves.
As to municipal waters, the code provides for proper coordination with the Province.
In case the National Government has a project in local seawaters, like a reclamation area, Maambong said, “The Province should have a say.”
Still on land use, Maambong said that Republic Act 779 or the Urban Development and Housing Act of 1992 is not clear on the provision that requires subdivision developers to provide socialized housing.
He pointed out that some urban subdivision developers pick far-flung municipalities for the required socialized housing sites, because the land there is cheaper.
Acting Gov. Agnes Magpale, who also attended the public hearing, said she hopes the code will be passed next month for the governor’s approval before the year ends.
