Prosecution team snubs senators’ remarks

THE prosecution panel ignored sentiments of senators sitting as judges in Chief Justice Renato Corona’s impeachment trial, saying the disclosure of evidence against him is allowed until the prosecutors have entered their appearances in the Senate trial.
Close Aquino allies — Senators Panfilo “Ping” Lacson and Francis “Chiz” Escudero — warned both sides to refrain from accusing each other regarding the impeachment complaint filed against the Chief Justice.
Lacson scored the 11-man prosecution panel for its “undisciplined public presentation of evidence” when it presented documents showing the Chief Justice and his wife’s purchase of a P14.5-million condominium unit situated at The Bellagio in Taguig City. The purchase was made back in 2009 when Corona was still an associate justice of the High Tribunal.
Spokespersons for the prosecution team, however, argued that the public prosecutors have not entered their appearances yet in the Senate; hence, the rule cited by the senators does not apply at the moment.
The Senate will reconvene as an impeachment court when Congress resumes session on January 16.
Asked whether the prosecution team will likely disclose more pieces of evidence against Corona, the panel’s deputy spokesperson, Aurora Representative Juan Edgardo “Sonny” Angara, said: “I know they are in possession of more information…No decision yet (if it will be released) as of the moment”.
The prosecution panel head, Iloilo Representative Niel Tupas Jr., said the release of more documents before the Senate trial “is possible” as the public has the right to know such pieces of evidence against the SC chief.
Tupas earlier called on Corona to prove that the 303-square-meter unit was declared in his Statements of Assets, Liabilities, and Net Worth (SALN).
Tupas stressed that the disclosure of Corona’s high-end condominium unit did not violate the “sub judice rule” of the Senate that will influence the impeachment court.
“We just disclosed a piece of evidence which we will prove during the trial. We never touched on the merits of the case. We only stated a fact as alleged in the complaint,” he said in a text message.
“With respect, the Senator may have missed the import of any trial. They are not games of surprises. I see nothing wrong in the prosecution team disclosing their evidence,” Isabela Representative Giorgidi Aggabao, also a member of the prosecution team, added.
In his answer to the impeachment complaint filed before the Senate, Corona admitted owning the condominium unit in question. He said it had been declared in his SALN.
A September 1992 SC en banc resolution issued during the term of Chief Justice Andres Narvasa, however, denies the disclosure of the SALN of the members of the Judiciary.
Corona’s failure to disclose his SALN to the public is the second article of impeachment stated in the complaint signed by 188 members of the House of Representatives.
House Deputy Speaker Lorenzo “Erin” Tanada III, one of the prosecution team’s spokesperson, said if Corona’s defense team would like to close the issue of the non-disclosure of Corona’s SALN, the Chief Justice should just release the document for the sake of public interest.
“Even the President files and discloses his statements of assets and liabilities. What makes the Chief Justice different from other government and public officials?” he told reporters in a press conference.
Meanwhile, in a press statement, Presidential Adviser on Political Affairs Ronald Llamas said the evidence gathered by the House prosecution panel against Corona can stand the “the most rigorous scrutiny” by the senator-judges in the forthcoming trial.
“The impeachment complaint signed by 188 congressmen is the product of thorough research and inputs submitted by concerned citizens who could no longer stand the willful and deliberate trampling of the Constitution and the rule of law by Chief Justice Corona,” Llamas said.
He denied that the complaint was the handiwork of 188 representatives of the people against Corona.
“It is the complaint of the overwhelming majority of Filipinos who want Corona removed because they want a clean, honest and impartial judiciary,” Llamas pointed out.
“Corona sits in the High Tribunal on the basis of an illegal appointment by disgraced former president Gloria Macapagal-Arroyo who now faces serious charges of electoral sabotage and plunder during her nine years of misrule,” he added.
Llamas said the House prosecution panel had also obtained documents that would show that Corona may have amassed ill-gotten wealth, including at least four multimillion-peso real estate properties, that “he could not have paid for out of his salary and allowances as an Associate Justice and Chief Justice of the Supreme Court.” (Kathrina Alvarez/Sunnex)
