SC spokesman asks lawmakers: Why single out Corona?

HOUSE allies of President Benigno Aquino III moved in an “unprecedented, lightning-like fashion” to impeach Chief Justice Corona, the Supreme Court spokesman who found the complaint as lacking in substance said Tuesday.
Speaking before members of the Manila Regional Trial Court Judges’ Association, SC spokesperson Midas Marquez chided the 188 lawmakers who joined the impeachment fray for not according due process to his boss.
“This astonishing, astounding feat has never been seen in response to urgent legislation long-pending and gathering dust in the halls of our revered Congress,” he said.
The articles of impeachment were already transmitted to the Senate on Tuesday although the actual trial will begin on January 2012 as the senators go on a holiday break.
Corona earlier hinted that he is ready to face the cases head on, a position echoed by Marquez in a huddle with reporters after the event.
“I believe he (Corona) will answer the complaint, point by point,” he said.
Dissecting through the allegations hurled against Corona, Marquez said these will not hold water due to lack of sufficient evidence.
“These charges can have no genuine motive other than to malign, to smear and to destroy the reputations of the Chief Justice, the Supreme Court, and the entire Judiciary,” he said.
Marquez also asked the lawmakers why they are trying to pin down Corona, a perceived ally of Aquino rival former President Gloria Macapagal-Arroyo, who is currently detained for poll sabotage charges.
Militant groups have since asked Corona to quit his post to give the Court a sense of objectivity as they cited his close political relationship with Arroyo and his consistent voting pattern in favor of the previous government.
“His is only a vote which is the same vote as the most junior member of the Court, so why single him out?” Marquez asked.
For her part, Justice Secretary Leila de Lima took the cudgels for congressmen who voted for Corona’s impeachment on Monday.
“This administration does not lie, bribe or threaten anybody. This (impeachment complaint) is the voice of the general public that’s why we had an overwhelming number of signatures,” she said in a chance interview.
Corona is the first Chief Justice to be impeached in Philippine history.
Secrecy in wealth of justices started in 1992
Among others, Corona was suspected of having accumulated ill-gotten wealth, acquiring pricey assets such as a 300-square-meter apartment in Fort Bonifacio, Taguig City, and bank accounts with huge deposits.
This is aside from the non-disclosure of his Statements of Assets and Liabilities (SALN), which to Marquez, is a non-issue.
“There is an en banc resolution that this will not be published. All justices from the time of CJ (Chief Justice Andres) Narvasa observed this jurisprudence,” he said.
The practice of secrecy with regard to the SALN of court employees started in 1992 during the term of Chief Justice Narvasa, who survived an impeachment attempt in 1997.
Chief justices after him, Hilario Davide, Artemio Panganiban, and Reynato Puno followed suit and recently, the Court denied the request of a certain Bala Tamayo to access the records on the wealth of the justices.
In a two-page en banc resolution last October 18, the High Court has denied the request for copies of the SALN of Corona and the 14 associate justices, saying the information can be used against them.
“The Court resolved to deny the request for a copy of the 2010 Statement of Assets and Liabilities of any (Supreme Court) Justice in accordance with A.M. No. 92-9-851-RTC (Re: request for Certified True Copies of the Sworn Statements of Assets, Liabilities and Net Worth) considering that the request may be directly or indirectly traced to a litigant, lawyer or interested party in a case pending before this Court,” the resolution read.
Marquez said copies of the SALN are with the Clerk of Court.
Currently, only the Philippine Center for Investigative Journalism (PCIJ), which earlier exposed alleged corrupt practices in the judiciary, has a pending request in getting the SALN of the justices of the High Court and the Sandiganbayan. (Virgil Lopez/Sunnex)
