Tomakin: Student visa — An Overview
March 26, 2011
THE United States of America has always been the Mecca for quality higher education. Foreign student enrolment in the US has increased dramatically in the last few years such that as of last count, close to a million foreign students are enrolled across American colleges and universities.
There are quite a number of Filipinos studying here in the US and if we were to conduct a survey today, there would surely be more students in the Philippines who desire to study in America.
There are three ways in which one can gain entry in the US through a student visa. All of these visas are for a temporary period and for a temporary purpose, thus each is a non-immigrant visa.
These visas are: F visa for academic study, M visa for vocational study and J visa for cultural exchange. Each of these visas has its own requirements but there are certain requirements that are common to both F and M visa applicants. These are:
1. Enrolment in an academic educational program, a language-training program, or a vocational program;
2. The school where you intend to study must be approved by USCIS;
3. The prospective applicant must be enrolled as a full-time student at the institution;
4. The prospective student must demonstrate that he or she is proficient in English or be enrolled in courses leading to English proficiency;
5. The prospective student must also be able to provide proof that he or she has sufficient funds available in order to support herself during the whole period of the program;
6. The prospective student must be able to show that he or she is maintaining a residence and is intending to reside in his/her home country after his/her program is finished.
For today’s article, we shall cover only the F and M visas as J visa has its own peculiarities and must be treated in a separate discussion.
Thus, in order for you to be admitted on a student visa, it is imperative that you must satisfy the above requirements. The best place to start your research whether you qualify for a student visa is your prospective school. Each school has its own office for international students staffed with qualified and experienced advisors who can better guide you in the whole tedious process. For practical purposes, this is where you should begin before you even make an application at the US Embassy.
Make sure that you can document and prove how you finance your study in the US. The source of funds must be legitimate and that it can be traced and properly accounted for. The amount of money must be substantial by itself and is sufficient to pay for the cost of study as well as your living expenses.
Take note that as F and M visa holders, generally, you are not allowed to work in the US, except under certain conditions. Some acceptable reasons for applying to work are extreme financial hardship, curricular practical training and optional training both of which must relate to your present program of study. These employments should also first be approved by the designated school official and by the USCIS.
Your spouses and children too can live and stay in the US under F2 or M2 non immigrant visas. As they are non immigrants, they are also barred from working in the US and their immigration status is dependent on your own status as well.
More importantly, make sure that you would be able to convince the consular officer that your purpose in the US is only to study and that you intend to go back to the Philippines after its completion. Make sure you must demonstrate that intent to come back by providing a plan or course of action after you have completed your studies, maintaining your ties here in the Philippines, if your job would still be available for you when you come back or if you are just on leave from work or anything that shows that your study in the US is just temporary.
