Bohol officials convicted for illegal fund disbursement

TWO former local officials of Batuan town in Bohol have been convicted for the illegal disbursement of public funds close to 20 years ago, the Office of the Ombudsman said.
Nacitas Dumagan Jr., former town mayor, and Primitivo Digamon, former treasurer, now face from six years and a month to 10 years and six months in prison after the Sandiganbayan anti-graft court found them guilty of nine counts of violating the Anti-Graft and Corrupt Practices Act. They also face from 12 years to 20 years for two counts of Malversation of Public Funds.
The charges stemmed from a complaint filed with the Office of the Ombudsman in the Visayas that prompted an investigation into check disbursements totalling more than P250,000 in 1993 to 1997 that were issued without the required vouchers. It was found that Digamon had failed to present vouchers and payrolls to account for the disbursements despite being asked to do so since 2001. The town treasurer also failed to record the release of the checks in the town’s General Fund ledger.
“Digamon simply resorted to general statements that the checks were drawn to defray salaries of employees, supplies and materials and various projects of the municipality while Dumagan plainly maintained that the checks were properly supported by vouchers when they were presented for his signature,” Sandiganbayan Associate Justice Alexander Gesmundo said in the court decision.
Associate Justices Roland Jurado and Napoleon Inoturan concurred with the decision, which also noted “a valid inference of misappropriation for the failure…to account for the disbursement of said checks.”
The two former officials have been ordered to pay the government back P256,823 in damages and have been fined P34,612. They have also been barred from public service.
Digamon also faces a separate sentence of from six years and a month to 10 years and six months for issuing a check without the former mayor’s signature. He will have to pay the government an additional P50,000 in damages. (Jonathan de Santos/Sunnex)
