DOLE issues Cease and Desist Order at North Haven Construction Project at Clarkfield

Clarkfield, Pampanga – The Department of Labor and Employment (DOLE) Regional Office No. 3 today issued a Cease and Desist Order signed by DOLE Regional Director Raymundo G. Agravante to Trass Construction Company from constructing the buildings of North Haven Pharmaceuticals at Clarkfield, Pampanga until further notice afteran accident occurred at the construction site of the respondent-company causing nine (9) casualties resulting to the deaths of four (4) employees, leaving five (5) others injured on March 2, 2012 at around 2:30 pm after the sudden collapse of a nine (9) meter height by twenty five meter length structure.

In Agravante’s report to Labor Secretary Rosalinda Dimapilis-Baldoz, the Order was executed based on the accident investigation conducted by DOLE Labor Inspectors Antonio Sicat, Jr. and Renato Pacheco.

The Order was received by Mr. Alex Diza, Project Engineer of Trass Construction Company, during a joint-meeting between the Officials and representatives of the DOLE, Clark Development Corporation (CDC), North Haven Pharmaceuticals, and Trass Construction Company at the CDC Office in Clarkfield this morning.

The same Order was also received by Mr. Cesear Mercado, President of the North Haven Pharmaceuticals, while CDC was furnished with a copy.

A Notice of Stoppage Order from the DOLE has already been posted at the construction site.

According to Director Agravante, DOLE’s initial investigation revealed that two (2) pulleys were found to be used in lifting materials during the actual construction which could have probably contributed to the sudden collapse of the vertical wall structure. In addition, three (3) more structures posed imminent danger to workers that as per observation were made from substandard materials.

Moreover, the posts and beams in supporting the structure were not fully constructed to support the walls being erected and that the installed beams in this project are of the same thickness as the hollow blocks used to support the structure.

Given the height of the wall, the materials used could not possibly hold the structure in place. Safety signages near the erected structures to warn passers-by and workers were likewise not found in the worksite, said Agravante.

Agravante also disclosed that during the course of the investigation, no proof of approved compliance to Section 5 of Department Order No. 13 on Construction, Safety and Health Program and Section 7 of the same DO on the provision of safety personnel were found.

During the said meeting presided by Engr. Mariza O. Mandocdoc, OIC/Vice President for Regulatory Services Group (CDC), Director Agravante said that the company should undergo training on Basic Occupational Safety on Construction Safety for all its forty two (42) workers which will be spearheaded by the Department of Labor and Employment, Regional Office No. 3, the Bureau of Working Conditions (BWC), and the Occupational Safety and Health Center (OSHC) and is directed to address all issues and concerns of the said accident on through a conference with the DOLE on March 6, 2012 at the DOLE Regional Office 3.

Trass Construction Company represented by Mr. Alex Diza, Project Engr. reported to DOLE and CDC that strong winds (ipo-ipo) hit one side of the said wall structure causing it to fall down and collapse towards the said involved casualties. He informed the DOLE and CDC that as of press time, the company has already extended financial assistance to the said victims and are closely monitoring the progress of injured workers at the Our Lady of Mt. Carmel Hospital, where they were immediately taken. Furthermore, they are currently working on the death benefits of those who died in the said accident.

Fatalities include Joel Villapando from Calawan, Laguna; Rico Mabaga of Sapang Bato, Angels City; Ryan Graduito of Dasmariñas, Cavite; and Erwin Laxamana of Capas, Tarlac.

Meanwhile, Rolly Sarmiento and Antonio Resores, both from Oriental Mindoro are still being observed in the hospital. Joven Mesa, Rey Calos, and Angilito Ganagnag, all from Concepcion Tarlac, have already been released from the hospital. Fortunately, Leo Navaro, was unharmed during the said incident.

“I have instructed the Technical Support and Service Division on Employment and Welfare of the DOLE Regional Office 3 and DOLE Pampanga Field Office to profile all casualties involved in this unfortunate incident for possible livelihood and financial assistance the DOLE can extend to them” said Agravante.

CDC, being a close partner of the DOLE, has also issued a similar work stoppage to Trass Construction Company until they comply with the recommendations of the DOLE. CDC has likewise extended financial assistance to the victims.

Engr. Mandocdoc said that the CDC, through its Building Utilities Regulatory Department, headed by Engr. Tarcisius Tiotuyco, will work hand in hand with the DOLE on the further investigation and outcome of the said accident and likewise intensify the implementation of occupational safety and health programs in all locators in the Clark Freeport Zone to prevent similar incidents from ever happening again.
