‘Impeachment case makes Aquino smarter than Marcos’

SMARTER than Marcos?
“The way that I look at it, yes,” said Senator Joker Arroyo, who opposed President Ferdinand Marcos a quarter of a century ago, adding President Benigno Aquino III has managed to consolidate power through the impeachment of Chief Justice Renato Corona.
This, without declaring Martial Law or involving the armed forces, he said.
In a press conference in his office, Arroyo said the quick impeachment of Corona, whom the President has been criticizing in public, was a “stroke of genius” that removed the independence of the three branches of government.
“The net effect of this will be Aquino will become an autocrat without declaring Martial Law,” he said.
An impeachment complaint was endorsed by 188 members of the House majority on Monday evening, with the House minority accusing the Palace of threatening to withhold Priority Development Assistance Fund releases for those who do not sign.
“They are geniuses at the House, they were able to read the articles of impeachment (that quickly),” Senator Arroyo said.
Aquino, speaking at a lunch with House allies on Tuesday, said the impeachment trial will hold Corona accountable for, among other things, ruling in favor of Pampanga Representative Gloria Macapagal-Arroyo by granting her petition for an injunction on a government order restricting her travel abroad.
Corona has been accused of graft, violating the Constitution, and of betraying the public trust.
“The people are entertained by that kind of show, but this is a bid for power disguised under the claim of a clean government,” Senator Arroyo told reporters. The senator also said that it is now difficult to criticize Malacañang because “if you attack the President, you are for Gloria (Arroyo), you are for Corona, (and) you are for corruption.”
The senator said Corona’s impeachment could lead to the creation of an “Aquino” court instead of one that is perceived to be biased for Representative Arroyo, former president.
Senator Miriam Defensor-Santiago, meanwhile, defended the quickness of the impeachment proceedings. She said that each house of Congress has its own rules of procedure and that the perception that the impeachment was done in a hurry does not make the impeachment complaint any less valid. “Apparently, these rules were followed, and so the transmittal to the Senate is proper,” she said.
Few senators have commented on the impeachment case, which they will judge as members of an impeachment court that might be convened in January next year.
Senator Sergio Osmena III, who ran under the Liberal Party slate in the 2010 elections, said Corona might resign to avoid trial.
With the articles of impeachment already transmitted by House justice committee members Iloilo Representative Niel Tupas Jr. and Mindoro Representative Reynaldo Umali Tuesday morning, the Senate is already preparing for the trial.
Senator Aquilino Pimentel III has cautioned his colleagues against speaking out on the impeachment case. “Sometimes the best comment is a ‘no comment’,” he said Tuesday.
No signs that Corona critics will inhibit
Senator Francis Pangilinan, a vocal critic of Corona, has yet to decide on whether he will inhibit himself from a pending impeachment trial but did not rule it out. “We will address the issue at the proper time,” he said in a text message.
Pangilinan, as well as Senator Franklin Drilon, have previously called on Corona to inhibit from cases involving Pampanga Representative Gloria Macapagal-Arroyo, who appointed him as chief justice before her presidency ended.
He said that it is still too early to decide whether or not to stay away from the impeachment trial since there is no formal motion for him or Drilon to do so. “We will decide on the matter should the issue be raised during the trial,” he said.
“We have to say, however, that the impeachment trial is a political proceeding and is not a judicial proceeding. The requirements for inhibition are not the same,” Pangilinan said. He cited the example of former vice president Teofisto Guingona Jr., who, while a senator, accused then President Joseph Ejercito Estrada of wrongdoing. Guingona stayed on as a senator-judge during the Estrada impeachment trial.
Guingona’s son, Senator Teofisto III, was in the same situation when former ombudsman Merceditas Gutierrez was impeached in March. Earlier that month, Guingona had released a draft committee report of the Senate blue ribbon committee that included a recommendation to impeach Gutierrez. He urged his colleagues at the House to fast-track impeachment proceedings against Gutierrez, who had been accused of inaction on allegations of corruption during the Arroyo administration.
He said he would decide on inhibition when challenged. That challenge never came, however, as Gutierrez resigned before the impeachment court could be convened.
Drilon, meanwhile, said that he will participate in the trial, saying he does not “see any basis nor justification” to stay away from the trial. He said he has only asked for Corona to inhibit himself from Arroyo cases “to maintain the integrity of the Supreme Court.”
“I have not prejudged Chief Justice Corona on any of the eight charges now being brought against him in this impeachment case,” he said. (Sunnex)
