Lawyer opposes special polls for Iggy’s district

A VETERAN lawyer urged the Commission on Elections (Comelec) on Monday not to waste money by holding special polls for the congressional district of the late Negros Occidental Representative Ignacio “Iggy” Arroyo.
Lawyer Romy Macalintan said there is no urgent reason to stage a special poll considering that the May 2013 elections is just a year away, adding the amount needed for such an election to fill Arroyo’s post could be better spent on basic services in his district.
The lawyer is optimistic that the government in the fifth district of Negros Occidental will continue even without the special elections.

At the same time, he said there is no law that explicitly calls for the holding of such an election as he cited as an example the post in the Senate left by President Benigno Aquino III when he ran for the presidency in 2010.

Republic Act (RA) 7166 or the Synchronized Election Act of 1991 provides that in case a permanent vacancy occurs in the House of Representatives at least one year before the expiration of the term, the Comelec shall call and hold a special election to fill the vacancy not earlier than 60 days nor longer than 90 days after the occurrence of the vacancy.

Early this month, the House committee on suffrage and reform said it will deliberate a resolution asking the poll body to conduct a special election to fill Arroyo’s vacant post.

A bill, House Bill 2171, was filed by Speaker Feliciano Belmonte Jr., Negros Occidental Representatives Alfredo Marañon III, Alfredo Benitez, Mercedes Alvares and Julio Ledesma seeking a special poll.

The bill argued that calling a special election will “uphold the system of democratic representation in government and to ensure the people of the fifth district of Negros Occidental are not denied proper representation in the 15th Congress, there is an urgent need to hold a special election to fill the vacancy in the said district.”

The move came after the Liga Ng Mga Barangay in Negros Occidental issued a resolution calling for the holding of a special election in the province’s fifth district. (AH/Sunnex)
