Prosecutors in impeachment case risk censure, senators say

HOUSE prosecutors might as well withdraw their complaint against impeached Chief Justice Renato Corona if they will insist on disclosing evidence in the case to the public, Senate President Juan Ponce Enrile, presiding officer of the impeachment court warned Thursday.
Enrile reminded Iloilo Representative Niel Tupas Jr., chairman of the House justice committee and lead prosecutor, to be fair to Corona and reserve the evidence for the trial. The impeachment court is set to reconvene on January 16, but the trial proper will likely not start on that day, its spokesman has said.
Senators Panfilo Lacson and Francis Escudero–chairman of the Senate committee on justice–have taken exception to the prosecution’s disclosure earlier this week of alleged evidence that Corona bought an expensive condominium unit in Taguig City.
Escudero said although the rules on impeachment only direct parties to refrain from discussing the merits of the case, “I hope they avoid it and show proper respect to the impeachment court.”
“If they persist in making comments or making public what evidence they have, I myself will put into a vote a possible contempt citation,” Lacson said Thursday, adding parties involved in the impeachment trial should respect rules of the proceedings. “This is sacred, this is enshrined in the Constitution,” Lacson said. To carry, the motion to cite the prosecution panel will need 16 votes.
Senator Aquilino Pimentel III, meanwhile, said the prosecution panel risks being disciplined by the impeachment court for its disclosure of evidence to the media. “They should be ready to face the consequence of their acts,” he said, although adding he is inclined to interpret the impeachment rules liberally.
He explained senators, who will hear the impeachment complaint, should also be able to filter out information not formally entered as evidence in the case.
Asked, however, whether the disclosure of evidence could be considered as discussing the merits of the case, Pimentel answered: “Actually, yes. That’s evidence. (That is included in the) merits of the case, actually.”
Meanwhile, in Malacanang, officials defended the House prosecution panel’s move to disclose evidence against embattled Chief Justice Renato Corona before the actual impeachment trial starts.
“It is up to the House prosecutors to see fit when they will show it to the public when they want to do it if they choose to do so, if they choose not to do so. It’s up to them. We cannot dictate upon the House prosecutors what their intentions are,” Presidential spokesperson Edwin Lacierda said.
Lacierda echoed the argument of the House panel, saying that the evidence is not new anymore and it was included in the complaint against the Chief Justice.
He also denied that there is trial by publicity going on in the case of Corona.
Meanwhile, Lacierda reiterated that the Palace will not call for the resignation of Corona to spare the public from the tedious impeachment process.
“We have already impeached the Chief Justice. If we would ask for resignation, they might say we are too presumptuous and arrogant,” he said.
Malacañang is leaving the fate of Corona to the Senate, which will convene as impeachment court on January 16 as Congress resumes its session.
But should Corona decide to resign, Lacierda said the Palace would definitely welcome it.
“If he decides to voluntarily resign, again, my statement is, in the same manner that the Ombudsman resigned voluntarily, we would certainly welcome the resignation. But as to calling for his resignation, we will leave it with the Senate impeachment court to conduct the trial,” he said, referring to former Ombudsman Merceditas Gutierrez, who quit her post days before the impeachment trial against was supposed to begin in May.
