Rodriguez: Flip-flopping will affect SC’s integrity

CITY OF SAN FERNANDO — League of Cities of the Philippines (LCP) president and City of San Fernando Mayor Oscar Rodriguez opined Monday that the recent flip-flopping rulings of the Supreme Court (SC) on the cityhood case of 16 municipalities will “greatly affect its integrity.”
Rodriguez’s statement came in light of the High Tribunal’s latest decision last week, where it upheld the constitutionality of the cityhood of 16 new cities, reversing for the third time the original ruling in 2008.
“My greatest worry is that these flip-flopping decisions will greatly affect the integrity of the Supreme Court. More so that these [flip-flops] have no basis and there are rumors that during a conference, there were other considerations taken. Pumapasok na sa consciousness na pati ba naman kataas-taasang hukuman ay ganoon? Iyon ang nakakalungkot,” said Rodriguez.
Aside from this great effect on the SC’s integrity, Rodriguez added the reversal of decision will “open the gates to indiscriminate conversion of unqualified local government units” into cities as well as the loss in internal revenue allotment of qualified cities, which he noted as the true engines of growth.
“In the City of San Fernando alone we could lose more or less P27 million a year in our IRA. Just imagine the big effect it will have on our programs and projects and delivery of basic services. In Puerto Princesa, some P100 million per year will be lost, for example, and serious projects will be affected,” Rodriguez told Sun.Star Pampanga.
“Hindi yata tama na pagkatapos makatanggap ng separate letters from the lawyers of the other parties, eh, biglang-biglang ini-entertain itong mga ganitong klaseng galaw. Ako naman ay hindi na particular dito pero definitely it will affect our [LCP] programs.”
He said the SC ruling was already final and executory, and that its “wishy-washy” decision has disregarded “precedents.”
“Our premise dito ay iyun mismong batas ay violation of the Constitution. Kung totoo ito ay talagang nakakalungkot,” he disclosed, adding the LCP’s National Executive Board is set to convene in an emergency meeting Monday afternoon to tackle the issue.
In 2007, the 16 municipalities involved were converted into cities. Upon petition by the LCP, the SC on November 18, 2008, voted 6-5, declaring the cityhood laws as unconstitutional.
Subsequently, on April 28 the following year, the court upheld its 2008 ruling with a 6-6 vote, denying a second motion for reconsideration filed by the towns that lost their city status.
On December 22, 2009 the High court restored the validity of the cityhood laws that converted the 16 towns into cities. But on August of 2010, the SC, voting 7-6 reinstated its 2008 ruling stripping the towns their cityhood status.
The LCP has since questioned the cityhood laws of 16 towns – Mati, Davao Oriental; Naga, Cebu; Bogo, Cebu; Carcar, Cebu; Baybay, Leyte; Catbalogan, Samar; Tandag, Surigao del Sur; Lamitan, Basilan; Borongan, Samar; Tayabas, Quezon; Tabuk, Kalinga; Bayugan, Agusan del Sur; Batac, Ilocos Norte; Guihulngan, Negros Oriental; Cabadbaran, Agusan del Norte; and El Salvador, Misamis Oriental.
