Tax bureau grants petitions to lower rate on public utility vehicles

CITY OF SAN FERNANDO — The Bureau of Internal Revenue (BIR) in Central Luzon has granted petitions to lower taxes on drivers and operators after the transport strike led by the Pagkakaisa ng mga Samahan ng Tsuper at Opereytor Nationwide (Piston) in Pampanga.
Lawyer Romula Aguila Jr., chief of the BIR in Central Luzon, has also suspended the collection of P5,000 worth of taxes and fines for 2009 and 2010.
Aguila said the common carrier tax (CCT) will be lowered based on the actual earnings of public utility jeepney (PUJ) operators and not on the uniformed P330 per month rate previously imposed by the agency.
“Indeed, this is a victory for the tens of thousands of PUJ operators in the region against the unreasonable, impossible and probably illegal tax burden and penalties imposed on us by the regional BIR office,” Reynaldo Gueco, spokesperson of Piston-Pampanga, said.
From the many dialogues initiated by the Clark Transport Federation since November 2010 with the tax agency, Gueco said their group has worked hard with numerous Jeepney Operators and Drivers Association (JODAs) representing thousands of PUJ operators in the province to bring the issue of excessive BIR taxes and penalties to the general public.
The demands of the PUJ drivers and operators have since gained strong support and sympathy from many sectors, including several local public officials, as was proven in the successful and well-supported transport strike launched by Piston-Pampanga last Thursday, Gueco said.
During the transport strike, the PUJ drivers and operators complained of rising oil prices and the BIR’s taxes and penalties.
BIR regional officials have been implementing Revenue Regulation 09-2007 as basis for the recent tax increase as well as the tax dues and penalties for the years 2009 and 2010.
Aside from the lowering of taxes, Gueco said they will push for an investigation of the legality of the recently scrapped tax increase and penalties that was based on a revenue regulation suspended in 2007 and will petition for either cash refund or tax credit for those of whom the BIR have already collected the questioned taxes and penalties from.
