Topacio blasts DOJ over Reyes watchlist order

MANILA, Philippines – Former Palawan Gov. Joel Reyes’ lawyer on Tuesday lashed out at the Department of Justice (DOJ) for including him in a watch-list order in connection with the murder of environmentalist and radio broadcaster Dr. Gerardo “Doc Gerry” Ortega.
Reyes is accused of being the brains behind the killing.
His lawyer, Ferdinand Topacio, said the watch-list order “is most unfortunate and shows the DOJ’s penchant for flouting the law and lawful orders of the courts.”
“The DOJ must be forcefully reminded that Department Circular No. 41 which authorizes the issuance of watchlist and hold-departure orders is the subject of a temporary restraining order by the Supreme Court, the case of Arroyo v. De Lima, et al., which has not yet been lifted. Therefore, there is no legal foundation for such an issuance pertaining to former Governor Reyes. This is on top of the serious constitutional issues involved in the reinvestigation of the case against Gov. Reyes, which is still pending before the Court of Appeals,” Topacio said in a press statement.
Ortega’s family earlier welcomed the finding of probable cause by the DOJ against Reyes for the killing of the radio broadcaster last January 2011.
Speaking to journalists at a news conference, Mika and Erika Ortega, daughters of Doc Gerry, said they felt relieved that the preliminary investigation is already concluded, and the case will now go to trial.
The Ortegas asked the court to issue a hold departure order against Reyes and his co-accused Mario Reyes, Jr., Romeo Seratubias, Arturo Regalado, Valentin Lecias, Armando Noel, Jr., Dennis Aranas, Arwin Arandia, and Rodolfo Edrad once warrants for their arrest are issued.
Topacio, however, said the DOJ may be violating legal processes.
“The DOJ should not consider itself above judicial processes by continuing to impose its will in the face of pending cases in court involving the powers it is now exercising; it should exercise a becoming modesty and give judicial courtesy to the courts, instead of arrogantly performing such acts which it fully well knows will be prejudicial and subjudice, or which may render such cases moot,” he said. “Such blatant disrespect for legal processes should not be the hallmark of a department led by a person who aspires to high elective office.”
“The challenge to the power of the DOJ to issue watchlist orders goes to the very heart of the constitutional presumption of innocence, right to travel, liberty of abode and other indispensable civil and political rights, and the DOJ should be more circumspect in using – and abusing – such prerogatives until after a definitive ruling from the Supreme Court is had in the matter,” he added.
