TV5 asks court to lift suspension vs Tulfos’ show

MANILA (Updated) — Broadcast network TV5 filed Friday a petition before the Court of Appeals, asking it to stop the government from continuously enforcing a decision putting public service program “T3: Kapatid Sagot Kita” off air for 20 days.
Central to TV5’s petition is the nullification of a preventive suspension order issued by the Movie and Television Review and Classification Board (MTRCB) on Thursday that developed after “T3” hosts delivered threatening remarks against couple Raymart Santiago and Claudine Barretto.
The hosts, Erwin, Raffy, and Ben Tulfo, are the younger brothers of noted columnist Ramon Tulfo, who was recently involved in a brawl with the celebrity couple at the Ninoy Aquino International Airport (NAIA).
TV5 said the order was a breach to freedom of expression and that the MTRCB overstepped its authority when it came out with the decision.
“The Tulfos have been sanctioned, what else is there for the government to resolve? A preventive suspension suggests that the continued broadcast of the program would constitute a danger to the viewing public,” the network said on Thursday.
The station, owned by tycoon Manny Pangilinan, said the agency has no power over news and public affairs programs like “T3,” but MTRCB Chairperson Grace Poe-Llamanzares begged to disagree.
In a radio interview, Poe-Llamanzares reiterated that “T3” does not follow a straight news format, thus the MTRCB can always intervene in the program’s content.
Sun.Star tried to reach TV5 lawyer Benjamin Tolosa for comment but he was unavailable as of this posting Friday.
The MTRCB earlier said that it found probable cause to charge the show for violating Section 3(c) of Presidential Decree 1986 for “airing scenes and utterances that are indecent and contrary to law, or with a dangerous tendency to encourage the commission of violence, or of a wrong or crime.”
Court sources said the case has been raffled off to the first division comprised of Associate Justice Amy Lazaro-Javier, Associate Justice Sesinando Villon, and Appeals Court Presiding Justice Andres Reyes Jr.
